TERMS OF SERVICE
Effective Date: February 25, 2025
Welcome to Cal EDD Connect (“Company,” “we,” “us,” or “our”). By accessing or using CalEDDConnect.com (the “Site”), you (“user” or “you”) agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of our Site, services, and any content or materials therein (collectively, the “Service”).
Please read these Terms carefully. If you do not agree with any part of these Terms, you must discontinue using our Service immediately.
- You must be at least 18 years old or have reached the age of majority in your jurisdiction to use the Service.
- By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.
Account Creation
You may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Prohibited Activities
You will not engage in activities such as transmitting malware, spam, or any other content that is harmful, disruptive, or offensive.
Service Description
- We provide automated phone calls to government agencies (like the California Employment Development Department (“EDD”)) on your behalf. We dial repeatedly until we reach a queue or agent, then attempt to bridge you into the call.
- We do not provide any legal or financial advice. We only facilitate phone contact with such agencies.
- We are not affiliated with EDD or any other government entity.
All text, graphics, logos, icons, images, and other materials on the Site (collectively, the “Content”) are our intellectual property or the intellectual property of our licensors.
You are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for your personal, non-commercial use. Any unauthorized use of the Content is prohibited.
One-Time Fee
You pay a one-time fee before we begin auto-dialing. This fee covers up to 2,000 call attempts or 18 working hours of calling, whichever occurs first.
Refund Eligibility
- If we fail to place you into the agency's hold queue within 18 working hours (or 2,000 attempts) of calling, you may request a full refund.
- No other refunds are provided unless explicitly stated at our discretion.
No Additional Charges
We do not charge extra for hold time or bridging calls, provided the call remains within the stated limit.
The Service is provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or secure.
We do not guarantee successful agent contact, faster claim resolutions, or any specific outcome. Our system may fail to detect agent arrival or the agent may hang up before bridging.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Service.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your use of and access to the Service;
- Your violation of any of these Terms;
- Your violation of any third-party right, including intellectual property or privacy rights.
We reserve the right, in our sole discretion, to terminate or suspend your account or access to the Service at any time, with or without notice, for any reason.
Upon termination, all licenses and other rights granted to you in these Terms will immediately cease.
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice on our Site or by other means.
Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in California.
No Recordings
We do not record calls or store audio content. We only maintain basic logs (like the fact a call was placed, timestamps, etc.), subject to our Privacy provisions below.
Potential Failures
Lines may be busy or blocked. Our system may be flagged or blocked by carriers if calls are too frequent. We do not guarantee a call will ever connect or remain connected.
User Missed Call
If you fail to answer when we bridge you to the agent, that counts as a completed attempt. We do not provide refunds in this scenario, as the system performed the bridging service.
This section explains how we collect, use, and store your personal information:
Information We Collect
- Phone Number: We collect and store your phone number to place calls and bridge you into the call. We store this indefinitely in our internal database.
- Payment Information: We may process your one-time fee via a third-party payment provider (e.g., Stripe). We do not store your full credit card details on our servers.
No Call Recording
We do not record or store audio content of calls. We only maintain basic call attempt logs, timestamps, and statuses (e.g., “Busy,” “Connected,” “Attempt #123”).
Data Retention
- Phone Number: Retained indefinitely to help with re-attempts, user records, and to provide proof of service if needed.
- Logs: We keep non-audio logs (date/time, status) indefinitely or as required by business needs.
Use of Data
- Service Delivery: We use your phone number to connect calls.
- Internal Analytics: We may analyze call attempt patterns to improve our auto-dial algorithms.
- No Third-Party Sharing: We do not sell or share your personal data with third parties, except as needed to complete the service (e.g., Twilio for placing calls) or to comply with law enforcement requests.
Data Security
We implement commercially reasonable measures to secure your data. However, no system is infallible. By using the Service, you acknowledge potential risks inherent in internet-based interactions.
User Rights
Access/Deletion: If you wish to request access to or deletion of your phone number from our database, contact info@caleddconnect.com. We will remove or anonymize it unless we are required by law or legitimate business reasons to keep it.
Children's Privacy
Our Service is intended for users 18 years and older. We do not knowingly collect personal information from minors.
For questions about these Terms or our privacy practices, please email info@caleddconnect.com.
